Examples of Two Common DUI Defenses Strategies

Motion To Suppress Evidence
One of the best defenses that can be applied to a DUI charge would be that the officer in question did not have proper grounds to conduct the traffic stop.  Basically, if the judge hearing your case is convinced of this fact though proper motion practice, then you case will be dismissed without the need of a trial.

Scientific Defense of Rising Blood Alcohol
With the rising blood alcohol defense, the law requires that your blood alcohol level is not greater than a level of .08% at the time of driving.  The blood alcohol levels before and after driving are completely irrelevant if you can prove that when you were driving, your blood alcohol level was below the .08% threshold.  
 
In most cases, you can have an expert testify on your behalf, depending on your pattern of consumption in your case.  Even though you tested above the .08% threshold, your blood alcohol content, at the time you were driving, may have actually been below the threshold.

HANDLING DUI CASES IN LAS VEGAS

Did you take a Breathalyzer test?
If you took the breathalyzer test and the result was .08 or above, the Nevada DMV will be notified.  In addition, it is likely that you received a temporary license advising when your driving privilege will be revoked.  Please notify Paul J. Adras, Esq. immediately in order to request an administrative evidentiary hearing and to attempt to preserve your driving privilege.
If you took the breathalyzer test, your driver’s license will be valid for a number of days only. Your attorney must contact the DMV to request a DMV hearing.  The DMV hearing request gives you permission to continue driving until the DMV hearing process is completed.  The administrative law judge must make the decision regarding the suspension of your driving privileges.

Did you take a blood test?
It can take at least thirty to forty five days for the blood test to be completed, and for the results to be forwarded to the DMV and to the prosecutor.  The blood test results are then reviewed by the DMV, and they will notify you of the results by letter.  The letter will inform you that your driving privileges have been suspended for a ninety-day period.  Please Contact Mr. Adras immediately upon the receipt of this letter to preserve your rights.

What can I expect?
All cases are unique, and are extremely fact-specific.  What you are charged with, whether or not it is your first offense, and the facts surrounding your arrest will greatly impact the outcome of your case.  Paul J. Adras, Esq. personally handles each and every one of his cases, from the arraignment (initial court hearing) through the final disposition of the case, trial or otherwise.  Please contact Mr. Adras immediately to protect all of your valuable and important constitutional rights.
Below is a general list of penalties set out by the State of Nevada for a first offense DUI:  from two days to six months in jail; fines and assessments ranging from $400.00 to $1,000.00; mandatory participation in a victim impact panel; DUI school; license revocation of ninety days; if your blood alcohol level is above .18, the court will require that you undergo an alcohol/drug assessment.
If an alcohol/drug assessment is required, this assessment will have to be done prior to your sentencing date. The outcome of the assessment often results in additional counseling and other requirements that could take several months to complete.
